1. These Terms and Conditions (“Official Rules”) shall be binding on you when entering this promotion (the “Promotion”) operated by Virgin EMI Records, a division of Universal Music Operations Limited, of 4 Pancras Square, London, N1C 4AG (“Virgin EMI”).
2. This promotion is open to UK residents excluding Northern Ireland.
3. This promotion runs from 00:00 on 12 April 2019 until 23:59 on 26^th April 2019, the closing date for entries being 26th April 2019. No entries will be accepted as eligible after midnight on this closing date.
4. This promotion is open to residents of the UK (excluding residents of Northern Ireland). Entrants aged 16 and under must ask their parent or guardian for permission to enter this promotion and agree to these terms and conditions. Virgin EMI reserves the right to request proof of age for entrants as well as parent’s or guardian’s consent. If entrants are aged 16 or under, entrants’ parent or guardian must consent to entrant entering this promotion and providing entrants’ details to Virgin EMI. Virgin EMI reserves the right to request proof of such parent, guardian or companions’ age in order to be eligible for the prize as detailed below. Virgin EMI reserves the right to reject and refuse entrants if valid proof of such parent, parent guardian or companion is not accepted by Virgin EMI.
5. Only one entry will be accepted per person for this promotion, and this will be the first entry received.
6. The promotion prize will include having your video selected to be used in an official fan music video for Jonas Blue’s song ‘What I Like About You.
7. The videos which will feature in the official fan video will be selected at the discretion of Virgin EMI from all the Correct Entries. Only the entrants whose videos have been selected will be contacted personally. Your personal data will be processed in line with Universal Music Group’s privacy policy: http://privacypolicy.umusic.com/
8. Entrants must record a video of themselves singing along to the song ‘What I Like About You’ by Jonas Blue ft Theresa Rex. Entrants must then submit the video through the portal hosted at https://www.jonasblue.com/what-i-like-about-you-video-competition/. (‘Correct Entries’)
9. Entrants will be deemed to have hereby given all requisite consents under the Performer’s Protection Acts 1958‑1972 (or any re‑enactments or amendments thereof) to enable Virgin EMI to incorporate entrants’ recording of their performances rendered in connection with the Jonas Blue song ‘What I Like About You’ (“the Recordings”). In regard to such recording and filming, entrants agree to attend at such times and places as reasonably requested by Virgin EMI. For the avoidance of doubt, entrants confirm that subject to the provisions of any relevant Agreements binding upon them with the Musician’s Union and/or Equity, Virgin EMI shall be entitled in perpetuity throughout the world without further payment or liability to entrant, to edit the Recordings and to use and exploit the Recordings in any manner whatsoever including without limitation by way of rental and/or lending and in all and any media worldwide, save in any advertisement or endorsement other than as permitted in (ii) below; and to use entrants’ photograph, name and likeness solely in connection with the promotion, advertising and/or packaging of the recordings or any associated Soundtrack or any programme, audio visual device or audio record in which the Recordings are reproduced. Entrant will be deemed to have warranted that they are entitled to give the above consents. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
10. The prize(s) must be taken as stated and cannot be deferred. There will be no cash alternative. Once prizes have been allocated and despatched they cannot be transferred. Virgin EMI reserves the right to substitute prizes of equal or greater value at any time.
11. Virgin EMI is not responsible for 1) failed, returned or misdirected notifications based on inaccurate information provided by the entrant on entry 2) entries, and responses to entrant notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer, mobile phone or technical error of any kind. Proof of sending is not proof of receipt.
12. Virgin EMI reserves the right, in its sole discretion, to cancel or suspend this promotion should a virus, ‘bug’ or other cause beyond Virgin EMI’s control corrupt the administration, security or proper play of the promotion. Virgin EMI reserves the right to modify the rules of the promotion in any way or at any time.
13. Entrants must supply full details as required above and comply with all rules to be eligible for prize(s). No responsibility is accepted for ineligible entries or entries made fraudulently. Deeming an entry void is at Virgin EMI’s absolute discretion.
14. This promotion is not open to employees or contractors of Virgin EMI, any person directly or indirectly involved with Virgin EMI or the running of the promotion, or their direct family members.
15. Virgin EMI’s decision is final and binding in every situation including any not covered in these rules and no correspondence will be entered into.
16. Virgin EMI reserves the right to cancel or change this promotion at any stage, if deemed necessary in Virgin EMI’s opinion.
17. Entrants whose videos have been selected will be notified via email.
18. An entrant may be disqualified from the promotion if he or she fails to comply with these official rules, as determined in the sole discretion of Virgin EMI. Unless prohibited by law, entry constitutes permission to use entrants’ and person/s accompanying the entrant/s names and likenesses in all media for publicity purposes without any further compensation. By entering or accepting a prize in the promotion, entrants agree to be bound by these Official Rules and to conform to all laws and regulations.
19. By entering, participants and persons accompanying the entrants, agree to release and hold harmless Virgin EMI, its parent, subsidiary and affiliated entities, directors, officers, employees, attorneys, agents and representatives from any damage, injury, death, loss, claim, action, demand or other liability that may arise from their acceptance and/or use of prize or their participation in this promotion, or from any misuse or malfunction of any prize awarded. Nothing in these terms and conditions affect an entrant’s statutory rights. Any limitation of liability to be insofar as permitted by law.
20. Entrants will be deemed to have accepted these rules and to agree to be bound by them when entering this promotion.
21. These Official Rules and this promotion shall be governed by English law and by entering the promotion all entrants agree that all disputes shall be submitted to the exclusive jurisdiction of the High Courts of Justice. This promotion is void where prohibited by local law.
